NYSDA APPLAUDS GOVERNOR CUOMO FOR SIGNING IMPORTANT DENTAL TELEHEALTH BILL
Amendment provides additional protections for dental patients
(ALBANY N.Y.) – The New York State Dental Association (NYSDA) is pleased Governor Andrew Cuomo has signed important legislation that requires dental telehealth services to adhere to the same standards of appropriate patient care required of any other dental health service delivery model. Telehealth services are a critical component of health care today. The use of telehealth has always been a way for both patients and practitioners to feel connected and to improve access to care; however, with the advent of at-home dentistry, whereby consumers and patients have sought out cheap and fast alternatives to certified dental procedures, some unqualified telehealth providers have wrongfully posed as dentists and have provided substandard care to patients or have placed patients at risk of malpractice or professional misconduct.
The amendment protects dental patients by requiring that dental telehealth providers identify themselves to patients and provide their New York State license number. It also stipulates that patients undergo proper examinations, necessary X-rays, and reviews of medical and health history before treatments can begin by a licensed dental practitioner. It further requires that telehealth providers cannot require patients to sign agreements to waive their rights to file complaints with any government authorities or waive liability prior to and during treatment.
“Certain unqualified dental telehealth providers are taking advantage of the public and causing harm to patients by failing to adhere to recognized standards of care for the services they provide. Dental professionals take an oath to do no intentional harm to patients. This amendment protects the patient,” said Dr. Mark J. Feldman, executive director, New York State Dental Association.
The bill, sponsored by Assembly Health Committee Chair Richard Gottfried and Senate Health Committee Chair Gustavo Rivera, amends Public Health Law s2999dd and is effective immediately.
